Community right to challenge

Under the Localism Act 2011, some groups can express an interest in running a local authority service or function. This is done by submitting an Expression of Interest (EOI) by groups such as;

  • voluntary groups
  • community groups
  • parish councils
  • local authority staff

If you are thinking of making an EOI, you can talk with us as far as possible in advance. We may be able to help you without having to submit an EOI.

All EOI forms will be received by the Director for Legal and Governance. They will acknowledge receipt of the form in writing within 30 days.

They will also include details of the process you need to follow and when we will be able to notify you or our decision.

Different periods may be set for different cases depending on their complexity. The longest period for determination will be 3 months to fit in with our budget setting process.

Expressions of interest will be reviewed by our relevant Directors. This is done in consultation with the relevant cabinet member. They use guidance issued by the Secretary of State.

If your EOI is accepted, we then have a procurement exercise to invite groups to bid to deliver that service. This may include more services where appropriate, for better delivery of the function.

Qualified organisations from the private, public and voluntary sectors will be able to tender. The group that submits an EOI may not win the contract.

We only consider applications between 1 April and 30 June of each year. This is to make sure we fulfil our duties to plan for future service provision and produce an annual budget.

We will let you know the longest period it will take to accept or reject your EOI by 31 July of that year. We will also publish details of the service specification.

We may need to discuss your EOI with you if there are elements that need clarification.
