Section 278 – Amendments or addition to the Existing Road Networks

Section 278 of the Highways Act 1980 allows developers to enter into an agreement with the Council. This is for works to be undertaken to make permanent amendments or improvements to a public highway. These works can only be carried out where Planning Permission has been granted.

From April 2024, Wakefield Council has adopted a new process for the completion of Section 278 Agreement. This is to provide the best service for developers and the people of Wakefield.

Please note that proof of Planning Permission and Land Title must be provided at the time of application.

Combined Section 278 and Section 38 Agreements

Section 278 Agreements may also be entered into jointly with a Section 38 (New Road Adoption) Agreement. Please refer to the “Adoption of Highways” page for the joint application.
